Cook With Kenyon — Terms of Service

This website and the Cook With Kenyon mobile application (together, the “Service”) are owned and operated by Kenyon International, Inc. (“Kenyon,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Service, available at cookwithkenyon.com and through the Apple App Store and other authorized app marketplaces.

BY TAPPING “AGREE” WHEN YOU FIRST OPEN THE APP, BY CREATING AN ACCOUNT, OR BY OTHERWISE USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Acceptance & Changes to These Terms

By using the Service, you agree to these Terms and our Privacy Policy. We may update these Terms at any time. Material changes will be posted with a new effective date, and for significant changes we may require you to affirmatively accept the revised Terms before continuing to use the Service. Continued use after changes take effect means you accept them.

2. Eligibility & Your Account

You must be 18 or older, or at least 13 with parental or legal guardian consent. Children under 13 may not use the Service.
If you are a parent or guardian permitting a minor to use the Service, you are responsible for that minor's activity.
You must provide accurate information, keep your login credentials secure, and notify us of any unauthorized access.
You may not create an account for someone else, resell or transfer your access, reverse-engineer the Service, or use bots, scrapers, or AI tools to harvest content without our written consent.
We may restrict access by region or jurisdiction where required by law.

3. The Service & Your License to Use It

We grant you a limited, non-exclusive, non-transferable, revocable license to use the website and App for personal or authorized business purposes. We may suspend or terminate this license, or modify, suspend, or discontinue any part of the Service, at any time. Maintenance and technical issues may interrupt the Service from time to time without liability to you.
If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement and the App Store's Usage Rules also apply. Apple is a third-party beneficiary of these Terms as they relate to the App, but has no obligation to provide maintenance or support.
Certain features require a compatible device and an internet, Wi-Fi, or Bluetooth connection. We may release updates; some features may require the current version of the App to keep working.
Support is provided only for issues directly related to accessing the Service — not for your device, network, or third-party services.

4. Recipes & Troubleshooting Content

The App and website may include recipes, cooking guidance, and product troubleshooting instructions (“Guidance Content”). Guidance Content is general information meant to be helpful — it's intended to complement, not replace, your product's official manual, a licensed technician, or your own good judgment.

Recipes may not account for every allergy, dietary need, or sensitivity, so please check ingredients before cooking — for yourself and anyone you're serving.
Following safe food handling, proper storage, and safe internal cooking temperatures helps ensure the best and safest results.
The App lets you set any target temperature for a cook, including one below the USDA’s recommended safe minimum internal temperature for that food. The App does not stop you from choosing a lower target, and you are responsible for the target you set. Check the USDA’s safe minimum internal temperatures (www.fsis.usda.gov) before cooking below them.
Ask Kenna, the App’s cooking and product assistant, uses artificial intelligence to generate its answers, including spoken answers. Its answers are Guidance Content. AI-generated answers can be incomplete or wrong, even when they sound confident. Check them against your product’s official manual, and do not rely on them alone for any safety-critical step, such as electrical, gas, or fire-related work, or food safety.
For troubleshooting that involves electrical components, gas lines, open flame, or structural work, we recommend disconnecting power or fuel where it's safe to do so and contacting a qualified, licensed technician rather than attempting the repair yourself.
Our troubleshooting content isn't a warranty repair authorization — for warranty-covered repairs, please reach out to Kenyon support or an authorized service center.

We work to keep product descriptions, pricing, and other information accurate, but errors can occur and we may correct them without notice. Products remain subject to their applicable manufacturer warranties.

Cooking, food preparation, and the use, cleaning, maintenance, and repair of kitchen and household products involve inherent risks, including but not limited to burns, cuts, electrical shock, fire, gas leaks, and foodborne illness. By using the Service, you voluntarily assume these risks. Content provided through the Service does not constitute technical, engineering, medical, dietary, or other professional advice. Please consult a qualified technician for product repairs, and a physician, dietitian, or other qualified professional for dietary or health-related questions, before relying on any Guidance Content.

5. Intellectual Property

All content, trademarks, logos, recipes, and other materials on the Service (“Materials”) are owned by or licensed to Kenyon and protected under U.S. and international law. Your license under Section 3 does not grant any rights beyond personal use.
You may not copy, distribute, or use Materials or our trademarks — including to train AI models or for other automated data mining — without our prior written consent.

6. User-Generated Content

If you submit reviews, comments, or other content (“User Content”), you grant Kenyon a worldwide, perpetual, irrevocable, royalty-free license to use, display, reproduce, and adapt it for business and marketing purposes. You confirm you have the necessary rights to the User Content and that it doesn't violate any law or third party's rights, and that it isn't unlawful, abusive, defamatory, infringing, or otherwise objectionable. We may remove User Content but aren't obligated to monitor it.

7. Third-Party Links & Services

The Service may link to or integrate with third-party services. We are not responsible for their content, policies, or practices — your dealings with them are solely between you and them.

8. Copyright Complaints (DMCA)

We comply with the Digital Millennium Copyright Act. If you believe your copyrighted work has been infringed, follow the process at copyright.gov and send notice to our designated agent: DMCA Copyright Agent, Kenyon International, Inc., 8 Heritage Park Road, Clinton, CT 06413. 9. Privacy & Data Security

We maintain industry-standard safeguards, but no system is completely secure, and we will notify affected users of any data breach as required by law. See our Privacy Policy for details on your rights under U.S. state privacy laws (including CCPA/CPRA, Virginia, and Colorado) and, if applicable, the EU/UK GDPR.

10. Orders, Payment & Product Warnings

By confirming a purchase, you agree to pay all applicable charges and taxes. We may cancel or refuse orders due to pricing errors, suspected fraud, or policy violations. Risk of loss passes to you upon delivery to the carrier.

Refunds and returns are subject to our Return Policy. Payment is processed by third-party providers (e.g., Stripe, PayPal); we do not store your full payment details.

California Proposition 65: some products may expose you to chemicals known to the State of California to cause cancer or reproductive harm. For details, visit www.P65Warnings.ca.gov.

11. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL GUIDANCE CONTENT, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY RECIPE OR TROUBLESHOOTING STEP IS ACCURATE, COMPLETE, ERROR-FREE, OR SAFE OR SUITABLE FOR YOUR SPECIFIC PRODUCT, EQUIPMENT, DIETARY NEEDS, OR HEALTH CONDITION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENYON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA — INCLUDING ANY CLAIM FOR PERSONAL INJURY, PROPERTY DAMAGE, OR FOODBORNE ILLNESS ARISING FROM YOUR USE OF GUIDANCE CONTENT — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID, IF ANY, TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) FIFTY DOLLARS ($50).

13. Indemnification

You agree to defend, indemnify, and hold harmless Kenyon and its officers, directors, employees, agents, and affiliates from any third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: your use of the Service; your violation of these Terms or applicable law; your violation of any third party’s rights; or any User Content you submit. We reserve the right to assume exclusive control of the defense of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense. This obligation survives termination of your account or these Terms.

14. Dispute Resolution & Arbitration

These Terms are governed by the laws of Connecticut, USA.
Any dispute will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), unless you opt out within 30 days of first accepting these Terms by sending written notice, with your name and the email address or phone number you use with the Service, to Kenyon International, Inc., Attn: Arbitration Opt-Out, 8 Heritage Park Road, Clinton, CT 06413, or by email to support@cookwithkenyon.com. Arbitration will take place in New Haven County, Connecticut.
You waive the right to participate in class actions; claims may only be brought individually. Small claims court remains available for qualifying disputes.

15. General Provisions

Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, supply chain disruptions, pandemics, labor disputes, or government actions.
Severability & Waiver: If any provision is found unenforceable, the remaining Terms stay in effect. Our failure to enforce a right is not a waiver of future enforcement.
Electronic Communications: By using the Service, you consent to receive notices, agreements, and updates from us electronically.
